In 2011, the Specialty Equipment Market Association (SEMA) began chasing a legal route for low-volume manufacturers (LVMs) to build and sell replica vehicles in the United States. This resulted in the introduction of H.R. 2675, the Low Volume Motor Vehicle Manufacturers Act, which sought to establish a program for LVMs, defined as manufacturers that produce up to 5000 vehicles annually, to sell their wares. Ultimately, much of H.R. 2675's content found its way into the Fixing America's Surface Transportation (FAST) Act, which President Obama signed into law on December 14, 2015.

As written, the FAST Act states that LVMs are eligible to build up to 325 replica vehicles each year, all of which are exempt from typical Federal Motor Vehicle Safety Standards and National Highway Traffic Safety Administration (NHTSA) rules. NHTSA and the Environmental Protection Agency (EPA) had one year to issue regulations to implement this new legal provision. But December 14, 2016, came and went without NHTSA doing so. Another year went by, and then another, and still nothing.

SEMA ended up suing NHTSA. "That lawsuit was integral in getting them to finalize and implement the law," recalls Eric Snyder, SEMA's senior director of federal government affairs.

On December 12, 2019, NHTSA's acting administrator signed draft regulations for replica-car compliance. NHTSA released the final rules in March 2022. In the ensuing time, essentially none of the LVMs that registered with and received approval from the government to produce replica cars have used the FAST Act's provisions to sell any such vehicles to the public. Did SEMA spend more than a decade concocting and fighting for a law that caters to a fictitious group of automotive consumers? Industry experts we spoke with indicated that the issue stems not from a lack of demand but rather from an inability to source powertrains that meet the requirements of the EPA or the California Air Resources Board (CARB).

LVMs are required to source a power train that's EPA-certified for the current model year, including all associated emission controls. And the powertrain supplier must warrant the catalytic converter, electronic control unit, and onboard diagnostic system for eight years or 80,000 miles.

CARB, meanwhile, requires both a replica car and its powertrain to receive Executive Orders (EOs) from the state of California confirming compliance. CARB also requires LVMs to warrant emission-related components for one year or 12,000 miles. Additionally, the powertrain manufacturer must back its product with a three-year or 50,000-mile warranty and a seven-year or 70,000-mile warranty that covers the setup's "high-priced" parts.*

A replica’s exterior dimensions can deviate from the original by up to 10 percent. The Meyers Manx 2.0 BEV (above) is 2.4 percent longer than the gas-powered original (top), while its height is cut by 8.1 percent.

As Lance Tunick, owner of Vehicle Services Consulting Inc., understands it, there's not a lot of cooperation from the engine manufacturers. "The replica process does involve obligations on their part, like warranties," he says. Between the additional costs, certification paperwork, and extra financial liability of mandated warranty requirements, manufacturers have little incentive to build a compliant powertrain for small runs of replica vehicles.

"I think there is reason to be optimistic," says Rob Simons, founder of Automotive Consulting Services, who adds that "there are options on the table that'll be available" in 2024. Just how many emission-compliant options LVMs will have to choose from remains to be seen, but at least one company seems ready to fill this void.

BluePrint Engines announced plans to contract with Ford Component Sales to bring to market the 2024 F-150's 5.0-liter V-8 as a purchasable complete powertrain package for replica cars. Simons is currently working with CARB to get an EO for the package. If all goes according to plan, this 400-hp V-8 will power many of the replica vehicles of the dozen or so LVMs with NHTSA approval.

But BluePrint's V-8 is not a one-size-fits-all solution. Caterham, for instance, which has NHTSA approval to build replicas of its Seven sports car (of Lotus fame), needs a more compact powertrain solution. Simon Lambert, Caterham's chief motorsport and technical officer, acknowledges that "for the Seven, a relatively small-capacity, lightweight engine is an essential ingredient." Lambert says the company is investigating multiple alternatives, including independently homologating a powertrain for U.S. use or possibly fitting the Seven with a battery-electric option. Going EV, however, does not eliminate the need for an EO and comes with its own set of hurdles.
